What are tenant rights in New York City in 2026?
New York State has some of the strongest tenant protection laws in the United States. As a renter in NYC you have the right to:
- A safe and habitable apartment (the implied warranty of habitability)
- Heat of at least 68°F (20°C) between October 1 and May 31 when outside temperature drops below 55°F, and at least 55°F overnight
- Hot water at 120°F year-round
- Protection against illegal lockouts or harassment
- A written lease upon request
- At least 30 days' notice before a rent increase or non-renewal (90 days for increases above 5% or non-renewals after 3+ years of tenancy)
- Return of your security deposit within 14 days of moving out
